Terms and Conditions of Use

Article (1) – Definitions

For the purposes of this Agreement, the following terms shall have the meanings assigned to them below unless the context requires otherwise:

Application: The Click Express electronic application.

Management: The entity that owns and operates the Application.

User: Any person who creates an account or uses the Application.
-
Order Creator: The User who creates a delivery request.
-
Driver: The User who provides delivery services through the Application.
-
Service: The electronic intermediation service connecting Order Creators and Drivers.

Article (2) – Nature of the Legal Relationship

The Application operates solely as a technical intermediary platform.

The Application shall not be considered a party to any agreement between the Order Creator and the Driver.

No partnership, agency, or employment relationship shall arise between the Management and any User.
-
Each User bears full and independent responsibility for their actions.

Article (3) – Eligibility of Use

The User must have full legal capacity.
-
The User must provide accurate and truthful information.
-
The Management reserves the right to refuse or suspend any account without providing reasons.

Article (4) – Responsibilities of the Order Creator
╚══════════════════════════════════╝
The Order Creator bears full responsibility for:

The content of the order.
-
The legality of the transported items.
-
The accuracy of the provided information and address.
The Order Creator further agrees to:

Pay delivery fees and any applicable charges.
-
Refund any amounts received from the Driver in case of order return.
-
Refrain from sending any illegal, hazardous, or prohibited materials.

Article (5) – Responsibilities of the Driver

The Driver shall deliver the order as received without alteration or tampering.

The Driver is responsible for verifying the legality of the order before transportation.

The Driver bears responsibility for any damage resulting from negligence or misuse.
-
The Driver must comply with safety instructions and directives issued by the Management.

The Driver bears any losses resulting from violation of laws or instructions.

Article (6) – Financial Transactions

All financial transactions are conducted directly between Users.

The Management bears no responsibility for:

Prepaid amounts.
-
Refusal to pay.
-
Financial disputes between Users.

Any fees paid to the Application for using the Service are non-refundable unless expressly decided otherwise by the Management.

Article (7) – Limitation of Liability

The Service is provided “as is” without any express or implied warranties.

The Management shall not be liable for:

Delays beyond its control.
-
Loss or damage of orders.
-
Misuse of the Service.
-
Disputes between Users.
-

The Management shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Application.

Article (8) – Monitoring and Disciplinary Actions

The Management reserves the right to monitor activity within the Application.

The Management may suspend or terminate any account in cases of:

Violation of these Terms.

Suspected fraudulent activity.
-
Damage to the reputation of the Application.
-

The Management shall have no obligation to compensate any User due to account suspension or termination.

Article (9) – Notices and Instructions

All notifications within the Application shall be considered binding.

Instructions issued through officially approved communication channels of the Management shall be binding.

The User bears responsibility for failing to review notifications.

Article (10) – Intellectual Property

All intellectual property rights related to the Application, including software, designs, logos, trademarks, and content, are the exclusive property of the Management and may not be used without prior written consent.

Article (11) – Force Majeure
╚══════════════════════════════════╝
The Management shall not be liable for any delay or failure resulting from circumstances beyond its reasonable control, including natural disasters, network outages, governmental decisions, or any unforeseeable or uncontrollable events.

Article (12) – Amendments
╚══════════════════════════════════╝
The Management reserves the right to amend these Terms at any time. Continued use of the Application constitutes implicit acceptance of such amendments.

Article (13) – Governing Law
╚══════════════════════════════════╝
This Agreement shall be governed by and interpreted in accordance with the laws of the Hashemite Kingdom of Jordan. The competent courts within Jordan shall have exclusive jurisdiction over any disputes arising herefrom.
